CMS Floors is a trading name for CMS FLOORS LTD. All purchases are subject to these Store Terms and Conditions. We reserve the right to change these terms and conditions at any time without notice. Any changes will take effect when posted on this website. By using this website, you agree to be bound by these Terms and Conditions. These Terms and Conditions do not affect your statutory rights.

1. The Contract
Acceptance of your order and the completion of the contract between us (CMS Floors Ltd.) and you (the customer) will take place when the goods have been paid for by you and dispatched by us. Any email order confirmation or other electronic acknowledgement by us of receipt of an order does not constitute legal acceptance by CMS Floors Ltd. of your order. In the event that there are any errors regarding price or description we reserve the right to notify you as soon as possible and give you the option to proceed with this revised order at the correct price/description or to cancel the order. In these circumstances upon cancellation your credit/debit card will be refunded in full.

2. Price Information
All offers are subject to availability and while stocks last. All prices are shown in £ sterling and exclude V.A.T. If an administrative error has resulted in an incorrect price being displayed, we reserve the right to correct that price and notify you accordingly. In these circumstances it will be deemed that a contract has not been entered into and you will not be bound to continue with your purchase. You will be asked to email us to confirm that you wish to proceed at the correct price however should you choose not to do so your monies will be refunded to your credit/debit card in full. The repayment of such monies paid to us will be the extent of our liability to you in the event of pricing errors.

3. Ordering Goods
Our online store can only accept orders from holders of credit or debit cards registered in the United Kingdom. We also only accept orders from addresses located in the United Kingdom. CMS Floors Ltd will confirm receipt of your order by sending an email to you using the address you supplied when registering with our website. This email is only an acknowledgement and does not constitute legal acceptance by us of your order. No contract will exist until payment has been received and goods have been dispatched. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. The only language in which the contract can be concluded is English. We cannot be held responsible for costs occurring as a result of delayed or cancelled deliveries. All delivery timescales are given as estimates and should be taken as such. For products ordered on account the products remain the property of CMS Floors Ltd until payment is made in full. CMS Floors Ltd will retain details of your order in our database and these details can be made available on request. Please email us at sales@cmsfloors.co.uk Due to a worldwide shortage of raw materials in 2021, some products bought online may require a surcharge retrospectively as prices are changing daily. If this is the case you will be telephoned by our team and can accept or decline to proceed with the order based on the new price.

4. Validation Checks
All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us we will not be liable for any delay or non-delivery.

6. Colours and Specifications
Representations of colour online are as accurate as photographic and electronic processes will allow. Please note that colour online can also be affected by the calibrations of different output devices. Samples of all our products are available and we therefore strongly recommend you request a sample for confirmation. We cannot be held responsible for the wrong choice in colour or product being made. We cannot guarantee the same colour on secondary orders due to possible batch colour differences.

7. Cancellations and returns
Consumers
As a consumer under the Consumer Contracts Regulations 2013 you have the right to cancel an order up to 14 days after receiving the products from us. If the order has been delivered in multiple deliveries, then your rights extend to 14 days after the final delivery. This applies to all products on our website excluding products that are produced to your specification which would include (but is not limited to) purchases of vinyl flooring under 40m2 (cut to size) furniture products logo mats and nosings/treads. Cancellation should be made in writing by email to support@cmsfloors.co.uk or by post to CMS FLOORS 164A Hornchurch Road Hornchurch Essex RM11 1QH. A full refund will be processed within 14 days of the date of your cancellation.

If cancellation occurs after receiving your goods, then the cost of collection will be deducted from your refund. The cost of collection equals the cost of delivery paid at time of purchase plus £6.00. If free delivery was provided with your purchase, then the standard delivery charge as detailed on our Delivery Rates page is applicable plus £6.00. We will arrange collection of the goods on your behalf on a day that is convenient with you no longer than 5 working days after your letter of cancellation. If you miss the collection on the date provided, then a further cost of collection at the same rate as the first collection will be applicable. If the second collection attempt is missed, then you will be responsible for returning the goods back to us within 14 days of your notice of cancellation at your own expense before a refund is provided. The two collection charges will be deducted from your refund. The goods must be returned unopened and in the same condition as you received them.

Should you receive goods from us that are unsatisfactory it is our responsibility to supply you with goods that meet your consumer rights. If you have concerns that we have not met our legal obligations, we would encourage you to contact us.

8.Fitting
8.1. CMS Floors Ltd fitting is provided by third party contractors. We have a minimum charge to be agreed before works start. All communication regarding your project fitting order materials and deadlines (including complaints) should be made to the staff at CMS Floors Ltd. and not the fitting team on site.
8.2. If images are requested to provide a quotation, they must show all areas of the project. If other areas become apparent when fitters arrive on site, then these will be chargeable.
8.3. Fitting dates on a project are based on a clear working project. The finish date is an estimate and could be liable to change depending upon site conditions.
8.4. Payment is to be made upfront before the installation commences in all cases unless a delayed payment plan is agreed by the Sales Manager in writing. The following terms would then apply to payment:
a) A 40% minimum deposit is required when fitting is booked which is fully refundable unless cancellation takes place within 7 working days or later of the fitting commencement date. If moving office furniture services have not been paid for and our fitters arrive on site with the furniture still in place, we will charge retrospectively the cost to move the furniture at our standard rates.
b) The balance is due on the final day of fitting.
c) For contractors working on behalf of a third party the remaining 50% balance to be paid on completion is subject to a credit check. If the credit check is unsuccessful, then the full balance for the fitting must be paid in advance of the fitting commencement date.

13.5. On completion of the fitting, you will be asked to sign an electronic sign off form. Once this sign off form is signed any subsequent remedial work that is brought to the notice of CMS Floors will be chargeable and CMS Floors will not be held liable for any repairs alterations or adjustments.
13.6. The CMS Floors 12-month fitting guarantee relates to product faults only. We do not accept responsibility or liability for any snagging or remedial issues that are brought to the notice of CMS Floors subsequent to the electronic sign off form being signed by the customer unless it can be demonstrated that the product is faulty or has been installed incorrectly by the CMS Floors fitters to a level that would not be considered a minor snag or multiple minor snags.
13.8. If the fitting is deemed to be completed by CMS Floors and the customer is unwilling to sign the sign off form then a third party fitter assigned and contracted by CMS Floors will be sent to appraise the work within 30 working days. If the assessment by this fitter is that the work is completed, then payment must be made whether or not the electronic sign off form is signed and the cost of the third party fitter will be added to the invoice balance due. If the third party fitter is in agreement with the customer and decides that the work is incomplete then CMS Floors have 30 working days to complete the work. Once completed the customer will then be asked to sign the sign off form. If the customer is unwilling to sign the sign off form, then the process is repeated until resolved.
